Scope creep costs the average freelance project between 23 and 40 percent of its expected revenue. That figure comes from projects where deliverables were never written down precisely enough for either side to point to them later. A contract does not prevent disagreements — it determines who has standing when one does.

Freelance contracts, service contracts, consulting contracts, independent contractor agreements, and work-for-hire contracts are the most searched types in this category. The disputes that come out of these engagements cluster around the same missing sections every time.

Scope of work causes more friction than any other clause. "Design a website" written as a single line leaves room for the client to expect five extra pages, unlimited revisions, and strategy calls that were never part of the conversation. A usable scope section lists specific deliverables, formats, revision rounds, and what falls outside the agreement.

IP ownership is the second most problematic area. Under US copyright law, work created by an independent contractor belongs to the contractor by default. A work-for-hire label alone does not transfer ownership — an explicit copyright assignment clause does, typically triggered upon full payment.

Kill fees protect against cancellations after significant work is done. Standard terms run around 25 percent if cancelled before work begins, scaling higher depending on project stage.

Contractor versus employee classification also causes problems. The IRS and Department of Labor apply behavioral and financial control tests to determine the actual nature of a working arrangement regardless of what the contract calls it.
