This Landscaping Contract is entered into as of [1. Effective Date] by and between [2. Client Full Name] (the “Client”) and [3. Landscaper Full Name], doing business as [4. Business Name] (the “Landscaper”), for services at [5. Property Address].

1. Scope of Services.

The Landscaper shall provide the services described in [6. Scope of Services], which may include installation, maintenance, mowing, planting, irrigation, and seasonal clean-up as specified. The services will be performed on the schedule set out in [7. Service Schedule].

2. Plant and Material Specifications.

Any plants, mulch, stone, or other materials used shall match the specifications in [8. Materials and Plants List]. The Landscaper warrants that all plant material is healthy and viable at the time of installation, and any plant warranty is described in [9. Plant Warranty].

3. Price and Payment.

The Client shall pay the Landscaper [10. Contract Price] for the services, payable [11. Payment Terms]. For ongoing maintenance, payment is due [12. Billing Frequency]. A late fee of [13. Late Fee] applies if payment is not received within [14. Grace Period] days of the due date.

4. Property Access and Damage.

The Client shall provide access to the property during the service schedule. The Landscaper shall take reasonable care to avoid damage to the property, including underground utilities, and shall be responsible for repairing any damage caused by its own negligence. The Client is encouraged to mark any buried lines or irrigation systems before installation work begins.

5. Weather Delays.

Services may be rescheduled due to rain, frozen ground, extreme temperatures, or other conditions that make the work unsafe or ineffective. The Landscaper shall notify the Client of any rescheduling and shall perform the services at the next available opportunity.

6. Insurance.

The Landscaper shall maintain commercial general liability insurance with limits of at least [15. Insurance Limits] and workers’ compensation insurance as required by law, and shall provide certificates of insurance upon request.

7. Changes.

Any change to the scope of services or materials shall be agreed in writing before the work proceeds, and may adjust the price accordingly.

8. Termination.

Either party may terminate this agreement for ongoing maintenance services with [16. Termination Notice Days] days’ written notice. For one-time projects, the Client may terminate upon payment for all work performed to date.
