This Catering Contract is entered into as of [1. Effective Date] by and between [2. Client Full Name] (the “Client”) and [3. Caterer Full Name], doing business as [4. Business Name] (the “Caterer”), for the event described below.
1. Event.
The Caterer shall provide catering services for the event described as [5. Event Description] on [6. Event Date] at [7. Event Venue], for an estimated guest count of [8. Estimated Guest Count].
2. Menu.
The Caterer shall provide the menu and service described in [9. Menu and Services], which includes the food, beverages, staffing, and equipment listed. Any menu change after execution of this contract requires written agreement and may adjust the price.
3. Allergens and Dietary Needs.
The Client shall provide the Caterer with a list of known allergens and dietary restrictions of the guests by [10. Dietary Info Due Date]. The Caterer shall make reasonable accommodations, but the Client acknowledges that food prepared in a shared kitchen may contain allergens, and guests with severe allergies should be advised accordingly.
4. Final Headcount.
The Client shall confirm the final guest count by [11. Final Headcount Date], at least [12. Headcount Notice Days] days before the event. The final price shall be calculated on the greater of the confirmed headcount or [13. Minimum Billing Count] percent of the estimated count, and no reduction in price shall be made for guests who do not attend.
5. Price and Deposit.
The Client shall pay the total estimated price of [14. Total Price] based on the current headcount, payable as follows: [15. Payment Schedule]. A non-refundable deposit of [16. Deposit Amount] is due upon execution to reserve the event date, and the balance is due [17. Balance Due Days] days before the event.
6. Cancellation.
If the Client cancels the event more than [18. Long Notice Days] days before the event date, the deposit shall be forfeited. If cancelled within [19. Short Notice Days] days, the Client shall pay [20. Cancellation Penalty] percent of the total price. If the Caterer must cancel due to circumstances beyond its control, the deposit shall be refunded.
7. Food Safety.
The Caterer shall comply with all applicable food safety regulations and maintain the required permits and licenses. The Caterer shall not be liable for illness caused by guests consuming food after the event if the food was not properly stored by the Client.
8. Alcohol.
If the event includes alcoholic beverages, the Caterer shall comply with all liquor laws, and service shall be limited to guests of legal drinking age. The Client acknowledges that the Caterer may refuse service to guests who appear intoxicated.
9. Property and Liability.
The Caterer shall take reasonable care to avoid damage to the venue and shall be responsible for damage caused by its own negligence. The Client shall be responsible for the conduct of guests.
