This Sublease Agreement is entered into as of [1. Effective Date] by and between [2. Original Tenant Full Name] (the “Sublandlord”) and [3. Subtenant Full Name] (the “Subtenant”), for the premises located at [4. Property Address].
1. Master Lease.
The Sublandlord is the current tenant of the premises under a lease with [5. Landlord Full Name] dated [6. Master Lease Date] (the “Master Lease”). This Sublease is subject in all respects to the terms of the Master Lease, and a copy has been provided to the Subtenant.
2. Consent.
The Sublandlord represents that the Master Lease permits subleasing and that the Landlord’s written consent to this Sublease has been obtained, as evidenced by [7. Consent Documentation]. If the Landlord’s consent has not yet been obtained, this Sublease is conditional upon it.
3. Term.
This Sublease begins on [8. Sublease Start Date] and ends on [9. Sublease End Date]. The Subtenant shall vacate the premises and return the keys on or before the end date, and no tenancy of any kind shall be created with the Landlord.
4. Rent.
The Subtenant shall pay rent of [10. Monthly Rent] per month to the Sublandlord, due on the [11. Rent Due Day] day of each month. Payment shall be made by [12. Payment Method]. The Sublandlord remains responsible for paying rent to the Landlord under the Master Lease.
5. Security Deposit.
The Subtenant has paid a security deposit of [13. Security Deposit Amount] to the Sublandlord. The Sublandlord shall return the deposit, less any lawful deductions, within [14. Deposit Return Days] days after the Subtenant vacates.
6. Utilities.
The Subtenant shall pay [15. Subtenant Utilities] during the term. The Sublandlord shall remain responsible for all other utilities under the Master Lease.
7. Compliance.
The Subtenant shall comply with all terms of the Master Lease and all applicable laws, and shall not cause the Sublandlord to be in default under the Master Lease. The Subtenant shall use the premises as a private residence and shall not further assign or sublet without written consent.
8. Liability.
The Sublandlord remains fully responsible to the Landlord for the performance of all obligations under the Master Lease. This Sublease does not release the Sublandlord from any liability under the Master Lease.
9. Default.
If the Subtenant fails to pay rent or breaches any term of this Sublease, the Sublandlord may terminate this Sublease and pursue any available remedy. The Sublandlord’s remedies include re-entry and recovery of possession in accordance with applicable law.
