Frequently Asked Questions

How much notice is needed to end a month-to-month lease?

Most states require 30 days' written notice from either party. Some states require more, so check the local rule before terminating.

Can a landlord raise rent on a month-to-month lease?

Yes, with proper written notice — typically 30 days. Rent control cities may have additional limits, so confirm local law first.

What happens if the tenant stays past the termination date?

The landlord can begin eviction proceedings, and the tenant may owe holdover rent for each day beyond the notice period.

Is a month-to-month lease automatically renewed?

Yes, it renews each month until either party gives written notice to end it. Rent continues at the agreed rate unless increased with notice.
