Equipment Rental Agreement Sample

This Equipment Rental Agreement is entered into as of [1. Effective Date] by and between [2. Owner Full Name] (the “Owner”) and [3. Renter Full Name] (the “Renter”).

1. Equipment.

The Owner rents to the Renter the equipment described as [4. Equipment Description], identified by serial number [5. Serial Number], in its current condition as inspected and acknowledged by the Renter on [6. Inspection Date].

2. Term.

The rental begins on [7. Rental Start Date] and ends on [8. Rental End Date]. The Renter shall return the equipment to [9. Return Location] on or before the end date, in the same condition as received, normal wear and tear excepted.

3. Fees.

The Renter shall pay a rental fee of [10. Rental Fee] per [11. Billing Period], due on [12. Payment Due Day]. A security deposit of [13. Security Deposit] is due before delivery, and a late fee of [14. Late Fee] applies if payment is not received within [15. Grace Period] days of the due date.

4. Use.

The Renter shall use the equipment solely for its intended purpose and in accordance with the manufacturer’s instructions. The Renter shall not sublease, loan, or transfer the equipment to any third party without the Owner’s prior written consent.

5. Maintenance and Damage.

The Renter is responsible for routine maintenance and for any damage to the equipment beyond normal wear and tear during the rental period. The Owner may deduct the cost of repair from the security deposit, and the Renter remains liable for any amount exceeding the deposit.

6. Insurance.

The Renter shall maintain insurance covering loss or damage to the equipment, naming the Owner as a loss payee, with coverage of at least [16. Insurance Coverage]. Proof of insurance shall be provided upon request.

7. Liability.

The equipment is provided “as-is.” The Owner makes no warranty of fitness for any particular purpose, and the Owner shall not be liable for any injury, loss, or damage arising from the Renter’s use of the equipment.

8. Default.

If the Renter fails to pay any amount due or breaches any term, the Owner may terminate this Agreement, take possession of the equipment, and pursue any available remedy, including retention of the security deposit.
